Driving While Intoxicated (DWI)/Driving While Ability Impaired (DWAI)
New York Vehicle & Traffic Law § 1192 makes it a crime to operate a motor vehicle while impaired or intoxicated. This is a serious offense with some eye-opening penalties.
DWAI means your abilities are impaired by alcohol. If your blood alcohol concentration is 0.07%, then you are presumed impaired. However, you can be convicted regardless of BAC if the state shows impaired driving.
You can also commit a DWAI through drugs or a combination of drugs or alcohol. This type of DWAI has more severe penalties.
DWI means you are intoxicated. Anyone with a BAC of 0.08% or higher is per se impaired. If the driver is under 21, then the BAC threshold is 0.02.

A first-time DWAI is punished by a fine of up to $500 or up to 15 days in jail, or both. If you have a prior DWAI or DUI in the past five years, then your penalties increase to at least $700 fine and imprisonment by up to 30 days in jail.
A first-time DWI or drug-based DWAI can result in up to a year in jail and a maximum $1,000 fine. If you have a prior DWI offense, then you are looking at a maximum of 4 years behind bars and a full $5,000 fine.

Reckless Driving
Driving in a dangerous way can lead to reckless driving charges under NY VTL § 1212. Blocking traffic or putting someone else at risk will qualify. You could face reckless driving charges for:
- Driving the wrong way in one-way traffic
- Excessive speeding
- Driving on the sidewalk
This is an unclassified misdemeanor offense, and if convicted, you can face up to 30 days in jail.
Driving with a Suspended License
You must have a valid driver’s license or permit to operate a motor vehicle on the road. NY VTL § 511 prohibits “aggravated unlicensed operation.” You can be convicted if your license is revoked, suspended, or withdrawn but you drive anyway despite knowing that you legally can’t.
This is a misdemeanor offense, and conviction leads to a $200-500 fine and up to 30 days in jail.
